Terms of Use (TOU)

1. Who We Are

Konstruct is a mobile application owned and operated by Konstruct Labs SA, a company incorporated in Geneva, Switzerland ("Konstruct", "We", "Us", "Our"). These Terms of Use ("TOU") govern Your access to and use of the Konstruct application and all related services (collectively, the "Services").

By creating an account or using the Services, You agree to be bound by these TOU. If You do not agree, do not use the Services.

2. Eligibility

You must be at least 16 years old to use the Services. If You are under 18, You confirm that You have obtained the consent of Your parent or legal guardian.

By using the Services, You confirm that the information You provide is accurate and that You are legally capable of entering into a binding agreement.

3. Your Account

You are responsible for maintaining the confidentiality of Your account credentials and for all activity that occurs under Your account. You agree to notify Us immediately at support@konstructapp.com if You suspect any unauthorized use of Your account.

We reserve the right to suspend or terminate Your account if You breach these TOU or engage in any conduct that We reasonably consider harmful to the Services or other users.

4. The Services

Konstruct provides a science-backed, gamified confidence-building application designed for personal development purposes. The Services may include:

• Educational video content and articles
• Challenges and interactive exercises
• Progress tracking, streaks, and gamification features
• An AI-powered coaching feature (see Section 5)

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

5. AI Coach and AI Features

Konstruct includes an AI-powered coaching feature designed to support Your personal development journey. By using this feature, You acknowledge and agree to the following:

• The AI coach is not a licensed therapist, psychologist, counselor, or medical professional. It does not provide medical, psychological, or clinical advice.
• The content generated by the AI coach is for informational and motivational purposes only. It should not be relied upon as a substitute for professional advice.
• AI-generated responses may not always be accurate, complete, or suited to Your individual circumstances. You use this feature at Your own discretion.
• If You are experiencing a mental health crisis or emergency, You should contact a qualified professional or emergency services immediately.
• We do not guarantee any specific outcome or result from using the AI features.

We continuously work to improve the accuracy and quality of Our AI features, but We cannot guarantee they will always function without interruption or error.

6. Subscriptions and Payments

Konstruct operates on a subscription model. A free trial of up to 7 days is offered to new users upon registration, giving You access to the full Services during that period.

• At the end of the free trial, Your subscription will automatically convert to a paid plan at the applicable rate displayed in the application at the time of purchase, unless You cancel before the trial period ends.
• Payments are processed through the relevant app store (Apple App Store or Google Play). Their terms and conditions apply to all transactions.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• We do not offer refunds except where required by applicable law.

7. Acceptable Use

You agree to use the Services only for their intended personal development purpose, and not to:

• Use the Services for any unlawful purpose or in violation of any applicable regulations
• Attempt to reverse engineer, copy, or exploit any part of the Services
• Use automated tools to access or scrape the Services
• Impersonate any person or entity, or misrepresent Your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the Services

We reserve the right to suspend or terminate any account that violates these rules.

8. Intellectual Property

All content, features, and technology included in the Services — including but not limited to text, graphics, logos, video content, software, and AI models — are the exclusive property of Konstruct Labs SA or its licensors, and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for Your personal, non-commercial use only. Nothing in these TOU transfers any ownership rights to You.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Konstruct Labs SA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to Your use of the Services, even if We have been advised of the possibility of such damages.

Our total liability to You for any claim arising out of or related to these TOU or the Services shall not exceed the amount You paid Us in the 12 months preceding the claim, or CHF 100, whichever is greater.

Nothing in these TOU limits Our liability for death or personal injury caused by Our negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Konstruct Labs SA, its directors, employees, and partners from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your use of the Services, Your breach of these TOU, or Your violation of any third-party rights.

12. Governing Law and Disputes

These TOU are governed by and construed in accordance with the laws of Switzerland. The courts of Geneva, Switzerland shall have exclusive jurisdiction over any dispute arising out of or relating to these TOU or the Services.

13. Changes to These TOU

We may update these TOU from time to time. We will notify You of material changes via the application or by email. Your continued use of the Services after such notice constitutes Your acceptance of the updated TOU.
